We are pleased to share the article “Some Jurisprudential Clarifications on the European Union Sanctions Against Russia”, authored by José Luis Iriarte, Professor of Private International Law at the Public University of Navarra.
The paper provides a structured analysis of case law of the General Court and the Court of Justice of the European Union concerning EU sanctions against Russia, clarifying key concepts such as “association” with sanctioned persons, material or financial support, and the notion of “leading businesspersons”. It also highlights the broad margin of discretion afforded to EU institutions and the resulting challenges for legal certainty.
The article has been published in Current Challenges for the Rule of Law in Europe (Dykinson SL, Madrid 2025), pp. 323-366.
