We would like to express our sincerest gratitude to El Confidencial for having included Fátima Rodríguez González, lawyer responsible for Criminal Law and Regulatory Compliance at Lupicinio International Law Firm, in their recent article.
Fátima has recently published her monograph entitled “The post-offense conduct of the legal person as a cause for exclusion from criminal liability”, based on her doctoral thesis, in which she argues that natural and legal persons should receive different criminal treatment. According to her thesis, the legal person is a fictitious entity and, therefore, lacks the awareness to commit crimes, unlike a natural person. Or as the old Latin axiom says: Societas delinquere non potest (a corporation cannot commit a crime).
The presentation of this work, held last January at the Ilustre Colegio de la Abogacía de Madrid (ICAM), was supported by three leading figures: Manuel Marchena and Antonio del Moral, magistrates of the Second Chamber of the Supreme Court, and Esteban Mestre, professor of Criminal Law at the University of Alcalá de Henares.
