We are pleased to share the article “El Tribunal de Justicia interpreta el artículo 5.1 del Estatuto de Bloqueo Europeo. Sentencia de 21 de diciembre de 2021” (“The Court of Justice Interprets Article 5.1 of the EU Blocking Statute. Judgment of 21 December 2021”), authored by José Luis Iriarte, Professor of Private International Law at the Public University of Navarra.
The paper provides a critical analysis of the EU Blocking Statute in the context of US secondary sanctions, addressing key issues such as the validity of contract termination, the burden of proof, and the balance between freedom of enterprise and the protection of the European legal order.
The article has been published in the book Derecho público, entre el poder y un audaz desafío por el Estado de Derecho. Libro homenaje al profesor José Eugenio Soriano García (Atelier Libros Jurídicos – Barcelona, 2023), pp. 399-414.
