INTERNACIONAL SANCTIONS DECEMBER 2022

International sanctions have become a very popular instrument of foreign policy. Once limited to a few cases, they now have a broad mandate. In principle, sanctions aimed at addressing gross violations of human rights, stopping arms sales to parties to armed conflicts and supporting peace negotiations are an important political tool. However, there is growing evidence that the practice of international sanctions has become more of a problem than a solution for a humane and peaceful international order. The main causes are the excessive use of sanctions in general and the increasing use of sanctions as an instrument of power. These developments have also increased the negative side effects of sanctions.

We believe it is important to keep a register of legal and natural persons sanctioned by the United Kingdom, the European Union and the United States of America. If your business is international, this may be of concern to you, as they affect not only the sanctioned countries and individuals, but also those who do business with them.

 

I. EUROPEAN UNION

  RUSSIA

  • On 3 December 2022, COUNCIL DECISION (CFSP) 2022/2369 of 3 December 2022 amending Decision 2014/512/CFSP concerning restrictive measures motivated by actions of Russia destabilizing the situation in Ukraine has been published in the Official Journal of the European Union.
  • On 12 December 2022, COUNCIL DECISION (CFSP) 2022/2432 of 12 December 2022 amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine has been published in the Official Journal of the European Union.
  • On 16 December 2022, COUNCIL DECISION (CFSP) 2022/2477 of 16 December 2022 amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions which undermine or threaten the territorial integrity, sovereignty and independence of Ukraine has been published in the Official Journal of the European Union.
  • On 16 December 2022, COUNCIL DECISION (CFSP) 2022/2478 of 16 December 2022 amending Decision 2014/512/CFSP concerning restrictive measures in respect of actions by Russia destabilizing the situation in Ukraine has been published in the Official Journal of the European Union.
  • On 16 December 2022, COUNCIL DECISION (CFSP) 2022/2479 of 16 December 2022 amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine has been published in the Official Journal of the European Union.

HUMAN RIGHTS

  • On 6 December 2022, COUNCIL DECISION (CFSP) 2022/2376 of 5 December 2022 amending Decision (CFSP) 2020/1999 concerning restrictive measures against serious violations and abuses of human rights has been published in the Official Journal of the European Union.
  • On 6 December 2022, COUNCIL DECISION (CFSP) 2022/2377 of 5 December 2022 amending Council Decision 2010/788/CFSP concerning restrictive measures in view of the situation in the Democratic Republic of Congo was published in the Official Journal of the European Union.

DEMOCRATIC REPUBLIC OF CONGO

  • On 6 December 2022, COUNCIL DECISION (CFSP) 2022/2377 of 5 December 2022 amending Council Decision 2010/788/CFSP concerning restrictive measures in view of the situation in the Democratic Republic of Congo was published in the Official Journal of the European Union.
  • On 8 December 2022, COUNCIL DECISION (CFSP) 2022/2412 of 8 December 2022 amending Council Decision 2010/788/CFSP concerning restrictive measures in view of the situation in the Democratic Republic of Congo was published in the Official Journal of the European Union.
  • On 9 December 2022, COUNCIL DECISION (CFSP) 2022/2377 of 8 December 2022 amending Council Decision 2010/788/CFSP concerning restrictive measures in view of the situation in the Democratic Republic of Congo was published in the Official Journal of the European Union.

DEMOCRATIC REPUBLIC OF KOREA

  • On 12 December 2022, COUNCIL DECISION (CFSP) 2022/2431 of 12 December 2022 amending Decision (CFSP) 2016/849 concerning restrictive measures against the Democratic Republic of Korea was published in the Official Journal of the European Union.

IRAN

  • On 12 December 2022, COUNCIL DECISION (CFSP) 2022/2433 of 12 December 2022 implementing Decision 2011/235/CFSP concerning restrictive measures directed against certain persons and entities in view of the situation in Iran was published in the Official Journal of the European Union.

MALI

  • On 22 December 2022, COUNCIL DECISION (CFSP) 2022/2543 of 12 December 2022 amending Decision (CFSP) 2017/1775 concerning restrictive measures in view of the situation in Mali was published in the Official Journal of the European Union.

LIBYA

  • On 13 December 2022, COUNCIL DECISION (CFSP) 2022/2440 of 21 December 2022 amending Decision (CFSP) 2015/1333 concerning restrictive measures in view of the situation in Libya was published in the Official Journal of the European Union.

 

II. UNITED STATES OF AMERICA

TERRORISM

  • On 1 December 2022, OFAC pursuant to Executive Order (E.O.) 13224, authorizing the imposition of sanctions to prevent the financing of terrorism, six (6) individuals and two (2) entities have been added to the SDN List.
  • On 8 December 2022, OFAC pursuant to Executive Order (E.O.) 13224, authorizing the imposition of sanctions to prevent the financing of terrorism, five (5) individuals, twenty-six (26) entities and one (1) vessel have been added to the SDN list.

NARCOTICS

  • On 2 December 2022, OFAC pursuant to Executive Order (E.O.) 14059, which authorizes the imposition of sanctions on aliens involved in global illicit drug trafficking, two (2) individuals have been added to the SDN list.
  • On 14 December 2022, OFAC pursuant to Executive Orders (E.O.) 14059, authorizing the imposition of sanctions on aliens involved in global illicit drug trafficking respectively, one (1) individual has been added to the SDN list.

NORTH KOREA

  • On 9 December 2022, OFAC pursuant to Executive Orders (E.O.) 13722, blocking property of the Government of North Korea and prohibiting certain transactions with respect to North Korea respectively, two (2) individuals and eight (8) entities have been added to the SDN list.

RUSSIA

  • On 9 December 2022, OFAC pursuant to Executive Order (E.O.) 14024, which authorizes the imposition of sanctions against Russia for its harmful foreign activities, including violation of basic principles of international law such as respect for the territorial integrity of other states, twenty (20) individuals, five (5) entities and one (1) vessel have been added to the SDN list.
  • On 15 December 2022, OFAC pursuant to Executive Order (E.O.) 14024, which authorizes the imposition of sanctions against Russia for its harmful foreign activities, including violation of basic principles of international law such as respect for the territorial integrity of other States, forty-four (44) individuals, twenty-one (21) entities and one (1) vessel have been added to the SDN list.
  • On December 22, 2022, OFAC pursuant to Executive Order (E.O.) 14024, which authorizes the imposition of sanctions against Russia for its harmful foreign activities, including violation of basic principles of international law such as respect for the territorial integrity of other States, ten (10) entities have been added to the SDN list.

IRAN

  • On 9 December 2022, OFAC pursuant to Executive Order (E.O.) 13846, reimposing certain sanctions with respect to Iran, three (3) individuals have been added to the SDN List.
  • On 21 December 2022, 2022, OFAC Executive Order (E.O.) 13846, re-imposing certain sanctions with respect to Iran, five (5) individuals and one (1) entity have been added to the SDN List.

ZIMBABWE

  • On 12 December 2022, OFAC pursuant to Executive Order (E.O.) [ZIMBABWE], re-imposing certain sanctions with respect to Zimbabwe, four (4) individuals, two (2) entities have been added to the SDN List.

 

III. UNITED KINGDOM

RUSSIA

  • On 9 December 2022, the UK Government, pursuant to the Regime: Russia (Sanctions) (Eu Exit) Regulations 2019, has added one (1) person to the UK Sanctions List (“UKSL List”).
  • On 13 December 2022, the UK Government has added sixteen (16) persons to the UK Sanctions List (“UKSL List”) under the Regime: Russia (Sanctions) (Eu Exit) Regulations 2019.

IRAN

  • On 9 December 2022 the UK Government, pursuant to the Regime: (Sanctions) (Human Rights) (EU Exit) Regulations 2019 to provide for the freezing of funds and economic resources of certain persons, entities or bodies implicated in the commission of serious human rights violations or abuses in Iran, has added ten (10) individuals to the UK Sanctions List (“UKSL List”).

HUMAN RIGHTS

  • On 9 December 2022 the UK Government, pursuant to the Regime: (Sanctions) (Global Human Rights) (EU Exit) Regulations 2020, added eight (8) individuals to the UK Sanctions List (“UKSL List”).

CORRUPTION

  • On 9 December 2022 the UK Government, pursuant to The Global Anti-Corruptions (Sanctions) Regulations 2021, has added five (5) individuals to the UK Sanctions List (“UKSL List”).

MALI

  • On 9 December 2022 the UK Government, pursuant to the Mali (Sanctions) (Global Human Rights) (EU Exit) Regulations 2020 (Mali (Sanctions) (EU Exit) 2020) has added one (1) person to the UK Sanctions List (“UKSL List”).

SOUTHERN SUDAN

  • On 9 December 2022 the UK Government, pursuant to The South Sudan (Sanctions) (EU Exit) Regulations 2019, has added two (2) individuals to the UK Sanctions List (“UKSL List”).

 MYANMAR

  • On 9 December 2022 the UK Government, pursuant to The Myanmar (Sanctions) Regulation 2021 (Myanmar (Sanctions) Regulation 2021), has added three (3) individuals to the UK Sanctions List (“UKSL List”).

 HAITI

  • On 28 December 2022 the UK Government has, pursuant to The Haiti (Sanctions) Regulations 2022, added one (1) person to the UK Sanctions List (“UKSL List”).
