Alert EU Council: The European Union intensifies its sanctions against Russia: new restrictive measures in response to “internal repression”

On 27 May 2024, the Council of the European Union adopted Regulation (EU) 2024/1485 introducing restrictive measures against Russian individuals and entities. These new sanctions framework targets alleged human rights violations in Russia in the context of internal repression.

The regulation imposes sanctions on individuals who, directly or indirectly, participate in the internal repression in Russia against political opponents or individuals critical of Vladimir Putin’s government. Internal repression is defined by the EU Council as, among other things, “torture and other cruel, inhuman, or degrading treatment or punishment, summary or arbitrary executions, disappearances, arbitrary detentions, and any serious violation of human rights and fundamental freedoms as defined in the relevant international human rights instruments.”

The punitive measures include a travel ban for individuals listed in the regulation’s annex, the freezing of assets and economic resources, and the prohibition of making funds and economic resources available to those individuals. Additionally, sectoral restrictions on the export of items that could be used for internal repression are implemented, as well as items primarily intended for use in the control or interception of information and telecommunications security. It is also prohibited to engage in activities related to such items (brokering, maintenance, etc.).

In this regard, Annex I of the regulation details a range of equipment that could be used for internal repression, such as firearms, ammunition, and related accessories; simulators for firearms training and specially designed software; bombs and grenades not included in the Common Military List; and other explosives not enlisted by the Common Military List, among others.
