Lupicinio International Law Firm is proud to announce the publication of the collective work Sanctions, Business and Human Rights, edited and coordinated by Professor Alena Douhan, United Nations Special Rapporteur on the negative impact of unilateral coercive measures.
This publication includes the chapter entitled The Prohibition on Providing Legal Advice to the Russian State and Russian Legal Persons in Article 5n(2) of Regulation (EU) 833/2014: The Position of European Case Law (The prohibition on providing legal advice to the Russian State and Russian legal persons in Article 5n(2) of Regulation (EU) 833/2014: The position of European case law). The chapter was written by Lupicinio Rodríguez, Managing Partner at LILF; Fátima Rodríguez González-Chávez, Coordinator of the International Law and Sanctions Department; and José Luis Iriarte, Professor of Private International Law at the Public University of Navarra.
This work examines how international sanctions prohibiting the provision of legal services to sanctioned states or legal entities create a high degree of legal uncertainty for the legal profession, especially in non-contentious situations. It highlights the practical difficulties already recognised by European case law, which affect both notaries and lawyers when determining the scope of the restriction and the nature of the services permitted. Furthermore, it is emphasised that these limitations affect the professional practice of lawyers and their right to property, by reducing their fees and income derived from legal practice.
