The imminent entry into force of the reform of the Spanish judicial system will mark a turning point in the management of legal disputes. One of its main innovations is the obligation for parties to try to reach a private agreement before going to court. This new approach places mediation and other alternative dispute resolution methods at the heart of the system, promoting a more agile, efficient and collaborative justice system. The article “La era del acuerdo: ¿triunfará la mediación?” (The era of agreement: will mediation triumph?), recently published in Cinco Días – Aranzadi La Ley, explores this issue and its implications. Our partner Esther Cubillo, Head of the Litigation and Procedural Department of the Lupicinio International Law Firm, contributed to the article.
In the article, Esther Cubillo highlights how our firm has historically promoted the search for transactional solutions, both in previous stages and during the development of litigation and arbitration proceedings. This practice is a response, among other things, to the increasing collapse of the courts in recent years, as well as to our philosophy of offering clients strategic alternatives that minimise time, cost and risk.
We would like to share this interesting article with all our readers. It can be accessed via the link below (Spanish).
We would like to thank Esther for her valuable and timely legal insight.
