We are pleased to share the article “Precisiones jurisprudenciales sobre el artículo 5, apartado segundo, del Estatuto de Bloqueo europeo” (“Jurisprudential Clarifications on Article 5(2) of the EU Blocking Statute”), by José Luis Iriarte, Professor of Private International Law at the Universidad Pública de Navarra.
The paper analyses, in light of recent case law of the General Court (2023) and the Court of Justice of the European Union (2021), several key issues relating to the application of Article 5(2) of the Blocking Statute, including the temporal scope of authorisations, the balancing of competing interests, and the position of affected third parties. It also highlights the practical limitations and shortcomings of the current framework, opening the debate on its potential reform.
The article has been published in Cuadernos de Derecho Transnacional, Vol. 16, nº 2 (octubre 2024), pp. 972–984.
