We share an article published by the Antitrust Alliance (ATA) on recent trends in the enforcement practice of the Italian Competition Authority (AGCM) concerning vertical agreements, with particular emphasis on resale price maintenance (RPM) and selective distribution practices. The article examines the decision adopted in March 2026 against Morellato, which was fined approximately €26 million for anti-competitive practices relating to resale pricing and sales through online platforms, as well as the subsequent investigations launched into Citizen, Swatch and DJI/Nital.
These proceedings suggest a possible shift towards stricter enforcement of competition rules in Italy, particularly regarding price monitoring, distributors’ commercial autonomy and restrictions on online sales. They also highlight the importance of reviewing not only the contractual terms of distribution agreements but also their practical implementation, ensuring that commercial policies comply with competition law and that restrictions imposed on distributors pursue legitimate objectives and are proportionate and non-discriminatory.
